Medicare Supplement Plans in New Mexico

Direct answer: Medicare Supplement insurance, also called Medigap, works with Original Medicare. Federal law standardizes the benefits of the lettered plans, but enrollment rights, underwriting and certain consumer protections can also depend on New Mexico law.

What Medigap does

A Medigap policy can help pay certain deductibles, coinsurance and copayments left by Original Medicare. It is not a Medicare Advantage plan and generally does not include outpatient prescription drug coverage, so beneficiaries who need drug coverage usually consider a separate Part D plan.

The federal Medigap Open Enrollment Period

A person’s federal Medigap Open Enrollment Period lasts six months and begins when the person is both age 65 or older and enrolled in Medicare Part B. During protected enrollment, companies generally cannot use medical underwriting to deny the policy or charge more because of health status.

Outside protected periods, underwriting may apply unless the beneficiary has another guaranteed-issue right or a state-specific protection.

New Mexico-specific protections

Federal Medigap protections include the six-month Medigap Open Enrollment Period that begins when a person is age 65 or older and enrolled in Medicare Part B, along with certain guaranteed-issue rights when specific qualifying events occur. New Mexico residents should review current guidance from the New Mexico Office of Superintendent of Insurance for any additional state-specific protections. New Mexico previously issued a temporary Medicare Supplement guaranteed-issue protection connected to the Medicaid unwinding. That bulletin was repealed in January 2026 and should not be treated as a current guaranteed-issue right. Current enrollment rights should be evaluated under applicable federal protections and New Mexico’s current Medicare Supplement rules.

Consumers should verify current state rules with New Mexico Office of Superintendent of Insurance (OSI) before assuming that a change in coverage creates a guaranteed right to buy a particular Medigap policy.

Compare standardized benefits and premiums

The benefits of a standardized Medigap letter plan are generally the same regardless of the company selling that letter. Premiums, pricing methods, discounts, customer service and rate history can differ.

Compare the same lettered plan across more than one insurer and confirm that the company is actively marketing the policy in the beneficiary’s area.

Before switching a Medigap policy

Do not cancel existing coverage until the new policy is approved and the effective date is clear. A beneficiary who gives up an existing policy may not have a guaranteed right to get it back.
